Public Input Sought on Sexual Offences Bill
The Government of the Virgin Islands has launched a territory-wide public consultation on the proposed Sexual Offences Bill, 2025. The draft legislation aims to modernize local laws regarding sexual violence, child abuse, and online exploitation. Residents and community stakeholders are encouraged to submit feedback on the discussion paper before the March 31, 2026 deadline.
The Government of the Virgin Islands has opened a Territory-wide public consultation inviting residents and community stakeholders to review and submit comments on the proposed Sexual Offences Bill, 2025. The draft legislation represents a comprehensive overhaul and modernization of the Territory's sexual offence laws.
Designed to consolidate and strengthen existing legal frameworks, the bill addresses critical issues including rape, sexual assault, child sexual abuse, abuse of positions of trust, human trafficking, and sexual exploitation. It also tackles contemporary challenges such as online crimes, specifically the non-consensual sharing of intimate images, while introducing enhanced legal protections for individuals with mental disorders.
Key structural reforms proposed in the bill include clarifying the statutory definition of consent, reinforcing evidential rules, strengthening anonymity protections for complainants, and introducing stiffer penalties that reflect the severity of sexual crimes. Wheatley, emphasized that community involvement is vital to producing robust legislation. He noted that the bill marks a significant step forward in safeguarding children, vulnerable persons, and survivors of sexual violence across the Virgin Islands. Honourable Wheatley urged residents, youth, advocacy groups, legal practitioners, and faith-based organizations to study the discussion paper carefully, emphasizing that public voices are essential to ensuring the final statute reflects the values and needs of the Territory.
Permanent Secretary in the Ministry of Health and Social Development, Ms. Tasha Bertie, highlighted the transparent nature of the consultation. She explained that the Ministry is seeking practical feedback on legal definitions, the proportionality of penalties, and the critical balance between safeguarding victim rights and upholding the rights of the accused.
The public's input will directly inform revisions to the draft before it is submitted to Cabinet and the House of Assembly for debate. Members of the public can submit feedback by emailing ministryofhealth@gov.vg or by mailing written submissions to the Virgin Islands Sexual Offences Bill Review at the Ministry of Health and Social Development, located at Vorinica’s House of Commerce in Long Bush, Tortola.
In-person consultation sessions will also be announced in the near future. Copies of the Discussion Paper and the draft bill are currently accessible through the Ministry. The deadline for all public submissions is March 31, 2026.
